FUNDS, BY STATE, FROM SETTLEMENT AGREEMENT REACHED IN NOVEMBER, 1998 BY 46 STATE ATTORNEYS GENERAL AND THE TOBACCO INDUSTRY -- AN OPPORTUNITY FOR NEW FUNDS FOR AGING PROGRAMS

In November, 1998, the Attorneys General of 46 states, the District of Columbia and 5 U.S. territories reached an agreement to settle lawsuits or disputes with the tobacco industry regarding expenditures the states had incurred under their Medicaid programs for tobacco-related health care costs. (Four other states -- Mississippi, Florida, Texas and Minnesota) had previously settled their lawsuits against the tobacco industry, and therefore, the funds listed below do not include these states.)

The amounts of funds each of the 46 states, the D.C. and the territories are scheduled to receive under these agreements are listed below in two detailed charts issued by the Attorneys General and the tobacco industry. The first chart lists the total amounts that each state is scheduled to receive over the 25 year period of the agreements. The second chart lists the annual payments that each state is to receive each year of the 25 year agreement.

It should be noted that the amounts listed in these charts are the maximum amounts each state may receive; there are a number of caveats or loopholes in the agreements which could reduce the amounts the tobacco industry would have to pay. Further, news reports indicate that the first payments may not be received by the states until spring of the year 2,000; this may be clarified later -- for more up-to-date information on this, contact your own Attorney General's office.

The Center for Social Gerontology (TCSG) has posted this information so that advocates for the elderly will be able to most effectively advocate within their own states for some portion of these funds to be appropriated for programs for the elderly. These funds will go into the general revenues of each state and will be appropriated annually for such programs as the Governor and legislature determine through the normal legislative appropriations process. Thus, these funds can be spent on anything the state determines, just as can revenues from income or sales taxes.

It is important to remember that older persons are the primary victims of the disease and death caused by smoking and secondhand smoke; it is only fair and reasonable that some portion of these funds go for programs which serve these victims. (See other information on TCSG's web site for data detailing the numbers of older persons who suffer and die from tobacco-related diseases. This information can be used to advocate for elders receiving some of the benefits of these settlements.)
